Draft TUPE Regulations Published

For the past 3-4 years we have been promised changes to the Transfer of Undertakings (Protection of Employment) Regulations 1981, better known as TUPE. These regulations apply when businesses transfer as a going concern, or a public or private undertaking outsources part of its business.

The new regulations, together with the Public Consultation Document, have just been published in draft form.

The regulations are due to come into force in October 2005. If you are planning a business transfer after that date, the re-drafted regulations will have to be taken into account when putting the deal together, and transferring employees’ contracts.
