Draft Age Equality Regulations Published

The Age Equality Regulations, due to come into force in October 2006, have been published in draft on the DTI website.

The Regulations are likely to have a great impact on employment and other relationships: they will impose new obligations on employers, providers of vocational training, trade unions, professional associations, employers' organisations, and trustees and managers of occupational pension schemes. They will give new rights to employees, the self-employed, contract workers, office holders, members of trade organisations and anyone in vocational training.

Specifically, the new Regulations will:
. prohibit age discrimination in recruitment, promotion and training;
. prohibit all retirement ages below 65 - except where objectively justified;
. remove the current upper qualifying age for unfair dismissal and redundancy rights;

impose upon employers a 'duty to consider' an employee's request to continue working beyond retirement; and

. Require employers to give employees at least 6 months' written notice of their retirement date.
 
Action to take now

Although implementation of the legislation is still more than a year away, it engenders such a cultural change that employers should begin now auditing practices and procedures that may create potential age discrimination issues.
